The interlocutor explains the timeliness of the bill by the fact, in particular, that there are currently huge risks in the country, among other things – regarding the implementation of organized terrorist acts.
Bakumov’s colleague, Deputy Chairman of the Committee on National Security, Defense and Intelligence Mariana Bezugla, is joining the party. According to her, Bill 7349 amends the Law on Combating Terrorism, which provides, inter alia:
- introduction of legal bases for anti-terrorist training of the population;
- identification of new subjects of the fight against terrorism (taking into account the modern system of public authorities) and determination of the powers of the latter;
- improving the powers of the Security Service of Ukraine as the main subject of the fight against terrorism;
- empowering the Anti-Terrorist Center (ATC) at the Security Service of Ukraine to carry out international cooperation in processing preliminary information about passengers;
- establishment of the Joint Center for Coordination of Search, Release of Prisoners of War and Illegally Deprived Persons as a Part of the ATC at the Security Service of Ukraine as a result of aggression against Ukraine; improving the procedure for forming and approving the ATC Interdepartmental Coordination Commission under the SBU;
- improvement of mechanisms for counteracting international terrorism by introducing Passenger Information Processing (API / PNR) systems based on the ATC at the Security Service of Ukraine;
- formation of the register of terrorist organizations, establishment of the order of their inclusion or exclusion from such register, and also definition of legal consequences of inclusion of the terrorist organizations in the register;
- delegating to the Government of Ukraine the authority to determine the mechanism for compensating for damage caused by a terrorist act;
- empowering counter-terrorism actors to participate in joint anti-terrorist activities with the participation of foreign states or intergovernmental associations by engaging their forces and means, as well as to conduct anti-terrorist activities in other states in accordance with international treaties and agreements.
In addition, amendments are being made to the Law of Ukraine “On Sanctions”, which provides for the inclusion of terrorist organizations in the entities to which sanctions may be applied by Ukraine, as well as the addition of new types of sanctions.
The adoption of the bill, according to the author, will contribute to the comprehensive strengthening of the capabilities of the national system of combating terrorism in the face of armed aggression by the Russian Federation.
“In the context of armed aggression by the Russian Federation, identifying and eliminating the causes and conditions that contribute to terrorist acts, detecting, preventing, stopping, detecting and investigating terrorist acts, minimizing and (or) eliminating the consequences of terrorism are extremely important in Ukraine’s national security. “she says.”
According to the authors of the bill, in recent years the system of public authorities has changed significantly, new bodies have been formed that actually perform counter-terrorism functions (BEB of Ukraine, DBR of Ukraine, NABU, Judicial Protection Service of Ukraine, etc.).
“Therefore, it is extremely important to determine such bodies of state success of Ukraine as subjects of the fight against terrorism,” the authors say.
Thus, according to the explanatory note read by UNN , the Bureau of Economic Security and the Armed Forces of Ukraine are added to the list of entities that directly carry out the fight against terrorism within their competence ; The National Guard, the Judicial Protection Service, NAPC, NABU and DBR, as well as intelligence agencies of Ukraine, central executive bodies that ensure the formation and implementation of state policy in the field of transport, etc.
The bill also clarifies the powers of entities that directly carry out the fight against terrorism. In particular, in addition to the existing powers, the SBU is tasked with anti-terrorist training and scientific and methodological support for anti-terrorist activities.
The document clarifies the grounds for including organizations in the register of terrorist organizations, in particular, it may be recognition of the organization as terrorist at the international level, court verdicts, established facts of terrorist activities abroad that threaten Ukraine’s national security and more.
According to Bakumov, the bill improves the process of bringing to justice for law enforcement agencies.
“Along with this bill, there is another bill that amends the Criminal Code of Ukraine, which defines the specifics of the qualification of criminal offenses, namely crimes in this area, and departs from the classic system of qualification of crimes,” he added.
