Speaking at the online conference “How to stimulate investment in the economy and increase the efficiency of state resources”, which took place on November 26 this year, the chairman of the Agrarian Committee of the Verkhovna Rada Mykola Solsky spoke about the privatization of state agricultural enterprises and the number of land assets.
According to him, state-owned agricultural enterprises have the right to cultivate almost 700,000 hectares of land, however, about 80-90% of these companies, due to various circumstances (mostly agreements with various investors), still do not cultivate the accountable land. Therefore, it makes sense to legalize these procedures as much as possible, so that both the state and the market benefit from it.
The privatization of state-owned agricultural enterprises is very different from the sale of ordinary enterprises, as they have a very specific asset. In the vast majority of agricultural enterprises, the value consists not so much of property that is not very interesting to the market, but of the right / opportunity to cultivate the land on which these state-owned agricultural enterprises operate. They process it in accordance with the acts of permanent use, in legal terms. And there are some nuances here, because the act of permanent use cannot be privatized, “Solsky said.
As he stated earlier, the privatization of the SOE from its land plots provides for the transfer of up to 15% to the reserve lands, which can also be obtained primarily by citizens who have benefits – and this is the category of participants in hostilities.
At present, the categories of citizens specified in Article 25 of the Land Code of Ukraine have the right guaranteed by the state to receive their land share (share) in the following order:
- employees of state and municipal institutions of education, culture, health care, located on the territory of the relevant council, as well as pensioners from among them up to 2 hectares;
- employees of these enterprises, as well as retirees from among them, the value and size in conditional cadastral hectares of land shares (units) of employees of relevant enterprises, institutions and organizations and retirees from among them are equal.
That is, immediately gave 15% to the reserve fund, from which land will receive first beneficiaries, then up to 2 hectares of workers and retirees of the social and cultural sphere of the village, finally the balance is evenly divided between employees and retirees of these enterprises and pay attention – due to privatization and communal agricultural enterprises.
