Draft Law No. 7484-1 proposes to grant the right to leave Ukraine to men who have three or more children under the age of 18, or two children under the age of 14, or one child under the age of 14 and a pregnant woman, or one child under the age of 3.
They also offer permission to travel abroad:
· women and men who independently raise a child (children) under the age of 18;
· women and men, guardians, custodians, adoptive parents, parents raising a child with a disability under the age of 18;
In addition, it is proposed to allow the following citizens to leave Ukraine:
· who have real estate, business (as owners or co-owners), permanent residence permit in other countries;
· have valid work (or sports) contracts for sailors (who are now often replaced by Russians at workplaces);
· to persons who, through the provision of such an opportunity, will actually bring more benefit to the national economy (and therefore defense capability) than by staying in Ukraine often without work and without the ability to support themselves and their families;
· for participation in international competitions, educational and training meetings, etc.
The bill also proposes to expand the categories of persons who are not subject to mobilization – from among those who already perform important functions in the rear.
“That is, they will also be able to mobilize, but on voluntary terms, when they believe that they are ready both physically and morally to defend the Motherland with weapons in their hands, and that it is in this role that they will be more useful to the state,” the explanatory note reads.
Yes, according to Art. 23 of the Law of Ukraine “On Mobilization Training and Mobilization” provides a deferment from conscription for military service during the mobilization of a certain category of citizens, and therefore they cannot be involved in military service without voluntary consent.
Thus, a person who has a deferment from military service, at the same time, does not have the opportunity to go abroad to meet his own needs or the needs of his family. In order to solve this issue, it is necessary to provide the opportunity to leave Ukraine to certain categories of persons specified in Article 23 of the Law of Ukraine “On Mobilization Training and Mobilization”.
Draft law No. 7484-1 on amendments to the Law of Ukraine “On Mobilization Training and Mobilization” and the Law of Ukraine “On the Procedure for the Departure from Ukraine and Entry to Ukraine of Ukrainian Citizens” is currently sent to the Committee for consideration.
Addition
Under martial law in Ukraine, men aged 18 to 60 are prohibited from leaving the country. Exceptions may be for men deemed unfit for military service, those who have three or more minor children.
Also, during martial law, it is allowed to release drivers carrying out the transportation of medical cargo, humanitarian aid cargo by road vehicles for the needs of the Armed Forces, other military formations, as well as the population of Ukraine.
