“Kyiv officials justify their desire by saying that the land allegedly belongs to the municipality, and therefore has the right to set a fee for parking cars anywhere, including in the yards of residential buildings,” the expert said.
“Local authorities, regardless of whether they are present or still in Soviet times, by approving housing construction, automatically transfer the land not only directly under the house but also with the adjacent territory. The boundaries of these adjacent territories are clearly defined in the decision of local councils. ownership of an apartment in a residential building, its owners automatically acquire the right to land under the residential building and the adjacent territory, “- said Kushniruk.
According to him, this follows from the very legal nature of the ratio of land ownership and all its improvements, including as a residential building built on it and its adjacent territory.
“It should be understood that without the right to use the adjacent territory, there can be no right to own housing,” said the expert.
